If you sell on Etsy, you might assume Etsy handles privacy compliance for you. They handle some of it — but there are significant gaps that are your responsibility, especially if you also have your own website, use email marketing, or use advertising tools.
What Etsy Handles
Etsy operates as a data controller for its marketplace. They have their own privacy policy that covers:
- Data collection on the Etsy.com platform
- Payment processing through Etsy Payments
- Etsy's own analytics and advertising
- CCPA consumer rights requests submitted through Etsy's process
When a customer shops on Etsy.com, Etsy's privacy policy governs the marketplace experience.
What Etsy Does NOT Handle for You
Your Own Website
If you have a standalone website (Shopify, Squarespace, your own domain) that links to your Etsy shop or sells products directly, that site's privacy compliance is entirely your responsibility. Etsy's privacy policy does not cover your separate website.
Email Marketing

When Etsy Sellers Need Their Own Privacy Policy
You need your own privacy policy if you:
- Have your own website (even a simple one-page site)
- Use email marketing with customer data from Etsy

- Collect customer data outside Etsy (custom order forms, social media, etc.)
- Ship orders yourself and maintain shipping address records
Even if you sell exclusively on Etsy.com with no external website, having a privacy policy in your Etsy shop's "About" section is good practice — it builds trust and prepares you for when you do expand.
What Your Privacy Policy Should Cover
For Etsy sellers with their own website:
- What data you collect (names, emails, shipping addresses, payment info, browsing data)
- Why you collect it (order fulfillment, marketing, customer service)
- Third parties you share data with (Etsy, shipping carriers, email marketing tools, payment processors)
- Consumer rights (access, delete, correct, opt out)
- How customers can submit privacy requests
- Cookie disclosures (if your website sets cookies)
Practical Steps for Etsy Sellers

2. Generate a privacy policy based on your actual data practices
3. Add a cookie consent banner if your site loads analytics or advertising scripts
4. Review your email marketing — ensure you have opt-out mechanisms and disclose data sharing
5. Document your data handling — where customer data is stored and who has access
